So DH and his sister got into an argument today over who should get the house...story is DH and I are living in the basement apartment of his grandmothers house bc she is elderly and this is preventing her from being put into a nursing home due to her health issues and also bc she cannot keep up on the maintence on the house by herself (like re-shingling, plumbing ect)so with us here doing those things for her is our "rent" DH's sister has lived here the past 5 yrs and moved out about 2 months before we moved here to live in her fiances moms house (which she bought). Her mom-in-law stays here for a month then goes back to LA to live there for 2-3 months with her husband (why they go back and forth is beyond me) so they are rarely there. When DH's gramma does pass away (hopefully a long time) the house will automatically go to his mom (state law here)and she is the deciding factor on who gets the house. DH and his mom had a talk and she said that if we do this and prevent her from going into a nursing home then the house is ours since we're the ones keeping the maintence up on it, but his sister seems to think she should get it bc she had spent the last 5 yrs here before moving out.

What would you do or what do you think?

Know what I think? I think that this is a bridge that is best crossed when you get to it. Grams could outlive you all, and it may be a bit macabre to divvy up her possessions before she's gone.

Now if--God forbid--she was already departed? I would say it should be whomever your Grams indicated before she passed and the executor (your Mom) should keep her wishes. So if Grams thought your sister-in-law should have it so be it, and the same if she choose your husband.

no one is really calling dibs on anything.I just wanted opinions on this if everyone was in the same situation. Just simply asking "what would you do"

I have to agree with Tee C. Hopefully, gma will know what each person has done and which she felt she appreciated the most. IMO, no matter who gets the house, I hope gma is properly taken care of BEFORE litigation on her stuff is started and the claws come out (assuming there are claws...)
